Résumé / Abstract : La notification des actes du procès est le vecteur privilégié de l’information donnée au sein du procès civil. Instrument majeur des droits de la défense et, plus largement, du droit à un procès équitable, la notification consiste, selon l’article 651 du code de procédure civile, à porter les actes à la connaissance des intéressés. Vue par la doctrine processualiste contemporaine comme protectrice des droits de la défense, la notification traditionnelle, accomplie sur support papier, notamment par des huissiers de justice, était, jusqu’à un passé récent, la voie privilégiée de l’information des parties au procès. Toutefois, avec l’avènement des nouvelles technologies, la notification traditionnelle est soumise à une épreuve de mutation sans précédent ; elle est même menacée de disparaître purement et simplement au profit de la notification par voie électronique. Les enjeux d’une telle évolution doivent être pleinement mis en lumière. En effet, la voie électronique se concilie mal avec la sécurité juridique. L’insécurité numérique et l’inadaptation de certains actes du procès au format numérique ne sont pas nécessairement compatibles avec ce principe fondamental. Peut-on vraiment concilier l’instauration d’un système de notification intégralement dématérialisé – aujourd’hui en voie d’expansion – avec la sécurité juridique ? Évitant résolument d’adopter une approche passéiste, la thèse se garde pour autant de plaider pour le tout-numérique. Il est proposé d’instaurer un système mixte de notification, conciliant en son sein les deux systèmes de notification – traditionnel et numérique. La mise en place d’un tel système mixte repose sur une division des actes du procès en deux grandes catégories – actes graves et actes normaux. La famille des actes graves doit rester entourée des garanties de la notification traditionnelle, tandis que la famille des actes normaux peut être soumise à la notification par voie électronique.

Résumé / Abstract : The notification of the acts of the lawsuit is the privileged vector of the information given within the civil lawsuit. A major instrument of the rights of the defense and, more broadly, of the right to a fair trial, notification consists, according to article 651 of the Code of Civil Procedure, in bringing the documents to the attention of the interested parties. Seen by contemporary processualist doctrine as protecting the rights of the defense, traditional notification, accomplished on paper, in particular by judicial officers, was, until recently, the preferred way of informing the parties to the proceedings. However, with the advent of new technologies, the traditional notification is subjected to an unprecedented test of mutation; it is even threatened to disappear purely and simply to the profit of the notification by electronic way. The stakes of such an evolution must be fully highlighted. Indeed, the electronic way is badly reconciled with legal security. The digital insecurity and the unsuitability of certain acts of the lawsuit to the digital format are not necessarily compatible with this fundamental principle. Is it really possible to reconcile the introduction of a completely dematerialized system of notification - which is now being expanded - with legal security? The thesis resolutely avoids adopting a backward-looking approach, but it does not advocate for the all-digital system. It is proposed to set up a mixed notification system, reconciling within it the two notification systems - traditional and digital. The establishment of such a mixed system is based on a division of the acts of the lawsuit into two main categories - serious acts and normal acts. The family of serious documents must remain surrounded by the guarantees of traditional service, while the family of normal documents may be subject to service by electronic means.
