Résumé / Abstract : L'apparition de la technique numerique a permis la mise au point d'instruments de musique nouveaux, tels les synthetiseurs, les ordinateurs ou les echantillonneurs. Le travail des compositeurs s'en trouve considerablement modifie, donnant naissance a de nouvelles formes musicales et influencant considerablement le rapport entre compositeur et interprete. La technique numerique a egalement bouleverse les conditions de diffusion des oeuvres et des interpretations. La these etudie les consequences des techniques nouvelles sur la notion de compositeur et sur celle d'interprete, et sur les nouveaux rapports qui s'etablissent entre producteurs d'une part et musiciens d'autre part. Il apparait que, plus qu'un changement fondamental d'orientation du droit d'auteur, c'est une adaptation du droit existant qui serait necessaire.
Résumé / Abstract : The arrival of the new digital technology has led to the development of new musical instruments such as synthetisers, computers or samplers. The working procedures of composers has so been significantly modified, giving birth to the new musical forms and affecting in a large amount the relationship between composers and interpreters. The digital technology has also upset the conditions of circulation of the works and of their interpretations. This thesis deals with the consequences of the new technologies on the concepts of composer and interpreter, and with the set up of a new relationship between producers on one side and musicians on the other. It occurs that what would be needed is an adaptation of the existing law of copyright to the new situation rather than a fundamental reshaping of it.
