Résumé / Abstract : Bien que la " vie privée " ou le " droit au respect de la vie privée " constituent des notions souvent utilisées, leur définition reste encore très délicate, à une époque où l'autonomie de l'individu et la protection d'une sphère réservée de sa vie apparaissent comme des thèmes essentiels. Face à l'imprécision de ces expressions et aux développements des nouvelles technologies de l'information et de la communication, il convient d'identifier les espaces de la vie des individus que le droit entend sauvegarder. Il faut distinguer les divers types de protection de la personnalité de l'individu : selon une approche positive, le droit garantira sa liberté, alors que selon une approche plus défensive, il garantira une sphère d'intimité. Notre recherche a pour but d'apporter un éclairage comparatiste sur la protection d'une sphère réservée au bénéfice de l'individu. Elle, se divise en deux parties, successivement consacrées à la définition de la notion d'intimité comme droit fondamental et à l'exposé du contenu de la protection de ce droit par les juges constitutionnels français et espagnol. La première partie identifie, à travers une approche des fondements historiques et conceptuels de la notion d'intimité, la spécificité et l'autonomie du concept de droit à l'intimité, ainsi que sa signification. La seconde partie expose la garantie dont jouit ce droit du fait de sa qualité de droit fondamental et fait apparaître la convergentes des protections constitutionnelles française et espagnole. L'examen du contenu de cette garantie constitutionnelle, ainsi que de ses prolongements dans le droit infra-constitutionnel et international aborde également les conflits qui sont susceptibles, au sein d'un Etat de droit, de surgir entre le droit à l'intimité et d'autres intérêts de valeur constitutionnelle. Cette recherche comporte en outre une bibliographie et un index alphabétique des matières.

Résumé / Abstract : Although the " private life " and the " right of a private life " are often employed, their definition is still very tricky, at a time now in which the protection of the individual and its " reserved sphere " are essential points. Facing the inaccuracy of the two notions, and the important development of the new information technologies, we need to identify the different spaces of personal life, that law tries to protect. We need to distinguish the different protection of the individual's personality: in a positive approach, law will garantee his liberty and, in a defensive approach, it will guarantee a " private sphere ". Our approach reaches to bring to a comparative light the protection of a " reserved sphere " for each individual. It slipts up in two parts: the first part will try to give a definition of the notion of privacy as a fundamental right, and study the contents of its notion and how french and spanish constitutional judges protect it. The first part identifies the specificy, the autonomy and the meaning of the notion of privacy, in an historical and conceptual approach. The second part tries to explain the garantees of the privacy as a fundamental right, and to show the convergence between the french and spanish protection. We try to tackle the contents of this constitutional guarantee and its effects in infra-constitutional law and international law, to show the conflicts that could appear between privacy and the other constitutional interest.
