Résumé / Abstract : Certaines catégories structurantes du contentieux allemand de droit public ont été forgées au cours du xixe siècle. L’organisation progressive des recours de droit public accompagne en particulier la détermination des rapports juridiques entre l’individu et l’État monarchique. L’affirmation des droits publics des particuliers, comme les controverses doctrinales s’y rapportant, traduisent la quête d’un équilibre entre l’État de droit et l’État-puissance. Les questions posées par l’aménagement concret des recours tendant à protéger ces droits s’inscrivent à leur tour dans cette problématique. Relevant d’une première forme de justice constitutionnelle ou concourant à l’établissement de la justice administrative, ces voies de droit portent également la marque de principes propres à la culture juridique allemande. Ces grandes lignes se structurent autour de la rupture qui procède tout à la fois de la révolution de 1848 et de son échec. Les conditions institutionnelles de la garantie des droits des particuliers sont ainsi successivement marquées par la politisation du discours juridique puis par la réduction de l’État de droit à la sanction formelle du principe de légalité. Si les termes des débats liés à la détermination des fonctions respectives du juge et de l’administration, et de leurs rapports avec la loi, sont posés dès le début du xixe siècle, la construction tant de la science du droit public allemand que de la justice administrative leur confère une nouvelle orientation. L’origine et la signification d’une première conception subjective du recours administratif contentieux sont à interroger dans ce contexte, et à la lumière des solutions développées en France.

Résumé / Abstract : Some structuring categories of German public Law have been elaborated during the nineteenth century. The progressive organization of public Law remedies was an important step in the clarification of the legal relationship between the individuals and the monarchic power. The affirmation of individual public rights, as well as the doctrinal controversies on the topic, are an illustration of the quest for optimal balance between the Rule of law and the State power. These legal remedies, reflecting the initial form of constitutional justice and contributing to the establishment of the administrative justice system, are also characterized by the distinctive traits of the German legal culture. These outlines are structured around the rupture that originated in the 1848 revolution, as well as in its failure. Thus, the institutional conditions of the guaranty of the rights of individuals are successively characterized by the politicization of legal discourse, followed by the reduction of the idea of the rule of law to the purely formal sanction of the principle of legality. Although the general terms of this argument about the determination of the respective functions of the judge and the administration, as well as their relationship with the Law, are already clearly articulated during the first years of the nineteenth century, the scientific construction of German public Law and the establishment of an administrative justice system give them a new orientation. Subsequently the analysis of the origin and the signification of a first subjective conception of the administrative legal remedy is necessary in this context, as also in the light of the solutions developed in France.
