Résumé / Abstract : La question du pouvoir du juge constitutionnel, administratif, pénal ou civil figure au centre des controverses doctrinales et des projets de réforme de la justice en France et en Italie. Par la mise en lumière des présupposés des arguments échangés, cette recherche ambitionne de rendre claires les oppositions doctrinales. Cette exploration des discours peut apporter une contribution utile à la compréhension des évolutions de l'État moderne dont les conceptions dogmatiques de la fonction juridictionnelle sont parties intégrantes. Qu'elles portent sur la question de l'attribution de la qualité d'organe de la fonction juridictionnelle ou de la détermination du régime juridique découlant de cette qualité, les thèses s'opposant partagent, chacune, les deux mêmes représentations conflictuelles de la fonction juridictionnelle comme fonction d'application et comme fonction de création du droit. Elles apparaissent tout au long de l'exploration des fondements juridiques des discours.

Résumé / Abstract : The issue of the power of the constitutional, administrative, criminal, or civil judge is at the center of doctrinal controversies and judicial reform projects in France and Italy. By uncovering the assumptions of the arguments used in those debates, this study aims to clarify the doctrinal oppositions at work. The examination of these discourses can contribute to an understanding of the evolutions of the modern state, including those dogmatic conceptions of the judicial function that form an integral part of the state. Whether they bear on the characterization of the judicial function as an organ of government or on the determination of the legal system that flows from this characterization, the opposing theses each share the same two conflicting representations of the judicial function : that of applying law, and that of creating law. These two representations appear throughout the examination of the legal foundations of the doctrinal discourses.
