Résumé / Abstract : La cotraitance, technique contractuelle de coopération entre contractants au profit d'un tiers, est surtout connue du domaine des marchés publics ou privés, ainsi que des projets de coopération internationaux de grande envergure. Pourtant, la simplicité du concept, la souplesse du mécanisme et l'utilité de ses applications, font de la cotraitance un instrument efficace, pour tout contractant désiraux d'associer une diversité de prestations contractuelles à un résultat unique et cohérent. La cotraitance est susceptible d'engendrer n'importe quel ensemble contractuel, divisible ou indivisible, par lequel plusieurs contrats s'exécutent, pourvu que les contractants prestataires s'engagent contractuellement à coopérer. Cet engagement de coopération consolide la pluralité éparse des contrats, en une opération juridique unique. Il ne s'agit pas d'une coopération qui serait l'expression de l'obligation de bonne foi de l'article 1134 alinéa 3 du code civil, mais d'une coopération dans laquelle un contrat puise, à la fois, sa cause et son objet. L'interdépendance contractuelle qui en résulte est atypique en ce sens que lorsque les contrats interdépendants s'exécutent, on n'observe pas, uniquement, des exécutions individuelles en nombre égal aux contrats de l'ensemble, mais des exécutions concertées, en direction d'un objectif commun. Chaque prestataire n'exécute pas seulement celui de ces contrats auquel il est partie, il l'exécute en coopération avec les autres. Par une même action contractuelle, il exécute deux engagements : un engagement classique et un engagement de coopération. On peut alors affirmer qu'il co-exécute, qu'il co-traite. Ce faisant, il exécute une obligation bien singulière. Il s'agit de l'obligation de cotraitance, obligation-cadre parce que générale et évolutive, dont l'exécution peut être contractuellement exigée, aussi bien par chacun des prestataires, parties à l'engagement de coopération, que par leur cocontractant commun, tiers à cette convention.
Résumé / Abstract : Co-treating is a contractual technique of cooperation between contracting parties for the benefit of a third party, and occurs particulary in public or private markets and large scale projects of international cooperation. Nevertheless, with the simplicity of its concept, the flexibility of its mechanism and the usefulness of its applications, co-treating is an efficient instrument for any contracting party wishing to associate a diversity of contractual provisions to a result that is unique and consistent. Co-treating is a liable to lead to a group of interrelated contracts, wether severable or entire, by which several contracts are executed, as long as the contracting parties undertaking to cooperate consolidates the sparse plurality of the contracts, in a unique legal act. This is not about the obligation of good faith of article 1134 of the French civil code, but rather a cooperation in which a contract finds both its cause and its object. The resulting contractual interdependence is atypical, in the sense that, when the interdependent contracts are executed, there are not only the same number of individual executions that there are contracts, but also planned executions towards a common objective. Each provider does not only execute the contract for which he is party, but he executes it in cooperation with the others. With a single contractual action, he executes two undertakings : a classic undertaking and an undertaking of cooperation. It can be asserted that he co-executes, he co-treats. By acting in this manner, he executes an unusual obligation : that of co-treating. This is a framework of obligation- because it is a general and flexible - the execution of which can be compelled contractually, by every one of the providers, parties to the undertaking of cooperation, and by their commun co-contracting party ; the third party to this agreement.
