Résumé / Abstract : Le traité CE donne au juge communautaire la possibilité d'être saisi au moyen de voies de droit autonomes. La jurisprudence montre que ces dernières entretiennent pourtant de nombreuses interrelations et interactions, formant un système cohérent, objet de cette étude. La recherche s'organise autour de la protection de deux types d'intérêts : la protection de l'autonomie communautaire (partie 1) et celle des individus, personne physique ou morale (partie 2).la protection de l'autonomie communautaire implique d'abord celle de la communauté par rapport aux états membres. Les recours en manquement et en annulation sont essentiels à la garantie du partage des compétences. Cette systématique horizontale est complète, grâce à une systématique verticale, impliquant le juge national par le biais du renvoi préjudiciel. La protection de l'équilibre institutionnel permet au juge communautaire d'utiliser les potentialités de ces voies de droit, en ajoutant le recours en carence. Cette structure a été ensuite adaptée par le juge pour garantir l'autonomie externe de la communauté vis-à-vis des états tiers. Cette tactique conduit à une déformation des recours et ne permet pas d'exploiter pleinement certaines procédures spécifiques comme la demande d'avis. Le juge communautaire aurait du privilégier une approche plus politique de la systématique des voies de droit pour garantir plus complètement l'autonomie externe, ce qui accepte de faire pour protéger les intérêts individuels. Le juge communautaire renvoie par principe cette protection au juge national. Il se réserve d'intervenir dans des cas exceptionnels. Cette construction semble aujourd'hui avoir atteint des limites structurelles et matérielles. Elles conduisent à repenser la protection de l'individu en renforçant la fonction communautaire du juge national et en assurant une intervention plus efficace du juge communautaire pour assurer à tout individu une protection effective de ses droits.
Résumé / Abstract : The EC Treaty defines a set of autonomous legal remedies. This does not mean that each of them is completely independent of the other. The case-law provides for numerous examples of interrelations and interactions between them. The aim of the research is to identify the existence of a coherent system of litigation at the European level. It is organised in two parts : the protection of the autonomy of the European Community (part 1) and that of the individual (part 2). The protection of the Community vis-à-vis Member States is first examined. The action of infringement of Community Law by a Member State and the action for annulment of an act of the institutions are of primary importance in this respect. It is efficiently completed by the co-operation with national judges through the reference for preliminary ruling. The protection of the institutional balance reveals the complete use ofthese remedies, including the action for failure to act. The protection of the Community vis-à-vis the third States is then studied. The EC judge chose to adapt the same combination of remedies to the specificity of external agreements, introducing a significant change in the use of each of them to protect the EC from external influences and to guarantee the correct application of the mie oflaw. Such a result is not convincing and shows that the EC judge should have privileged a more political approach. It does so when individual protection is at stake. The national judge is empowered to protect the Community rights of individuals. The EC judge has only an exceptional jurisdiction to deal with it. Such a division of powers is nowadays not fully satisfying as the national protection reveals structural and material limits. The protection of individuals should therefore be revisited to reinforce the Community powers of national judges and to guarantee a more efficient intervention of the Community Courts.
