Résumé / Abstract : L’entreprise est une réalité fiscale incontestable. Bon nombre de mesures fiscales font dépendre les droits ou les obligations qu'elles édictent de son existence. De ce fait, l'entreprise ne se confond aucunement avec les notions traditionnelles qui lui servent uniquement de supports juridiques (fonds de commerce, société...). Le droit fiscal appréhende en effet l'entreprise à travers son activité dont il s'agit d'imposer les résultats et des biens affectés à cette activité dont il s'agit d'imposer les mutations. L’entreprise se caractérisant ainsi par l'existence d'une activité économique organisée. En cela, on peut affirmer que l'entreprise est bien objet du droit fiscal. Est-elle pour autant un sujet de droit fiscal ? Cette doctrine consiste alors à rechercher la notion d'entreprise autour du sujet entreprise en démontrant l'autonomie à l'égard de la personne physique ou morale qui en est le support patrimonial. Ainsi, le fondement essentiel de l'affirmation d'une telle personnification fiscale de l'entreprise repose sur la reconnaissance fiscale d'un patrimoine et d'un intérêt qui lui seraient propres. Pourtant, l'entreprise n'ayant pas de personnalité juridique n'a pas plus de personnalité fiscale, en ce sens qu'elle n'est jamais le débiteur de l'impôt.

Résumé / Abstract : Firm is an indisputable fiscal reality. A lot of fiscal measures have rights and obligations which they decree, depended on its existence. Thereby, firm no can be mingled with the traditional notions which are only used as juridical supports (business with goodwill, company...). The fiscal law considers indeed firm through its activity to which it is question to tax not only results and goods allocated to this activity but also mutations. So, firm is caracterized by the existence of an organized economic activity. For that, we can affirm that firm is effectively object of fiscal law. For all that, is it a subject of fiscal law? Then, this doctrine consists in searching the notion of firm about subject firm by demonstrating the autonomy with regard to individual and legal entity which is the patrimonial support. So, the essential foundation for stating such a fiscal personification of firm is based on the fiscal recognition of a patrimony and an interest which would be its own. However, as firm has not legal entity, it has not either fiscal entity in that it is never fiscal debtor.
