Résumé / Abstract : La spécificité du droit du travail maritime se dessine à deux niveaux : structurel, relationnel et renforce l'obligation du maintien d'une législation particulière à ce milieu. le niveau structurel met en évidence une définition particulière du marin et du navire, propre au droit du travail maritime. Le marin professionnel ne peut être assimilé à un travailleur terrestre, parce que son lieu de travail mobile en fait un travailleur particulier. Le métier de marin est soumis à des conditions strictes d'entrée et de maintien dans la profession. Ces caractères renforcent la spécificité de ce milieu. Le niveau relationnel privilégie le contrat d'engagement maritime; individuelles ou collectives, les relations de travail dans le milieu maritime gardent leur spécificité.
Résumé / Abstract : The specificity of maritime labour law stands out on the one hand at a structural level, and on the other hand at a relationship level, and strengthens the need to maintain a special legislation for this profession. The structural level places in a prominent position a particular definition of the sea man and of the ship belonging to maritime labour law. The professional sea man cannot be assimilated to an ordinary worker, because the place where he works is model, and makes him a particular worker. Sea men are submitted to strict conditions their admittance and maintenance in the profession. The relationship level privileges the maritime work contact, which is the link between the ship-owner and the sea man. However one considers this profession, it undoubtedly deserves particular regulations, which is the only solution to give an appropriate answer to its problems and needs.
