Résumé / Abstract : En droit international positif, la notion de traité inégal présente la particularité d'être définie par référence non pas à l'égalite souveraine, mais aux manquements à la liberté du consentement. Cette pluralité de critères semble à la fois complexe et paradoxalement insuffisante pour appréhender la réalité des traités inégaux. Il apparaît alors nécessaire de rechercher un critère satisfaisant, permettant de "détecter" les traités inegaux. Et c'est dans la cause de l'obligation de chacune des parties au traité, par analogie avec le droit des obligations, que semble résider le critère du traité inégal.

Résumé / Abstract : In international law, the notion of unequal treaty has the characteristic to be formed without reference to the sovereign equality : the definition is founded on the lacks of the freedom of consent. But, with such criteria, it seems very difficult and inadequate to appraise the reality of unequal treaties. It was necessary to search for a satisfied criterium to define the unequal treaties. And therefore the cause of a valid contract which lies with each party to the treaty, as in private law, might be founded in the criterium of unequal treaty.
