Résumé / Abstract : La place de la commune peut être réinterrogée face à la place croissante de l’intercommunalité dans son domaine d’intervention historique que constitue la prise en charge d’une activité économique, ou encore au regard des aides économiques locales visant au développement économique du territoire. Le mouvement d’intercommunalisation des compétences semble réduire la place et la légitimité de la commune en ces domaines. Il s’agit de s’interroger sur l’éventuelle résistance communale relativement à ces types d’interventions. Comment fait-elle face à ces éventuelles diminutions ? Le juge permet-il certaines souplesses ? La présente étude se propose ainsi d'examiner l'intervention économique des communes à l'épreuve de l'intercommunalité tant au titre de son intervention directe, laquelle consiste en la prise en charge d'une activité économique, qu'au titre de son intervention indirecte, laquelle consiste en l'attribution d'une aide au profit d'une entreprise. L'analyse permet de démontrer que, en ces domaines, la commune est dépassée et eprouvée par l'intercommunalité.

Résumé / Abstract : The place of the communes can be re-interrogated in the face of the growing role of intercommunality in its historical field of intervention, which is the assumption of responsibility for an economic activity, or with regard to local economic aid aimed at the economic development of the territory. The movement towards intercommunalisation of competences seems to reduce the place and legitimacy of the communes in these areas. The question is whether the local authorities are resisting these types of intervention. How does it deal with these possible reductions, and does the judge allow certain flexibility? The purpose of this study is to examine the economic intervention of the communes under the test of intercommunality both under its direct intervention, which consists in the assumption of an economic activity, and under its indirect intervention, which consists in awarding aid to a compagny. The analysis shows that, in these areas, the communes is diminished and rivaled by intercommunality.
