Résumé / Abstract : Le sujet abordé dans cette thèse couvre aussi bien la question du silence gardé par l'administration donnant lieu à décision implicite (avec les évolutions récentes de la question, dont les motivations sont à étudier) et les hypothèses de carences fautives. La réflexion comporte un axe théorique (de quoi parle-t-on ? Est-ce une fiction juridique ?), historique (comment s'est construite cette préoccupation de faire porter des conséquences juridiques à l'inaction de l'administration et quelle est son origine ?), de science administrative (la question interroge évidemment sur la relation administration/administré : les évolutions récentes n'ont-elles pas modifié cette relation au détriment de l'intérêt général ?) et, enfin, de droit positif (quelles conséquences le droit applique-t-il à l'inaction de l'administration?).
Résumé / Abstract : Most of the research that has looked at the silence of the Administration is either very old or very quick on the notion, sometimes even both at the same time. In addition, the positive meaning of silence was virtually excluded from all studies on the subject of the implicit decision until almost 1991. The consequence that can be drawn from this observation resides in the absence of reflection before 1991 on the practical implications of the implicit decision, a fortiori of the positive implicit decision. Indeed, the hypothesis of a generalization of the positive meaning of administrative silence having taken the legal world by surprise, it then became necessary to study in depth this legal fiction which had hitherto remained in the shade. In order to understand better the legal fiction that is the implicit decision, we conducted a study of the subject, starting from the origins of said fiction. Therefore this research shall be combining a historical and conceptual approach, with a positivist analysis allowing the mechanism to be fully understood in a practical way. The final objective is to update knowledge on this subject, to assess the relevance of the system in effect, and finally to suggest prospective reflection on the future of this legal fiction. From a general standpoint, more than the evolution represented by the reform of November 2013, it is rather the “revolution” it figures, but also the one it foreshadows, that best justifies the relevance of this research.
