Résumé / Abstract : Cette thèse contient les controverses sur la mutation du principe de l'interdiction de l'emploi de la force, tant au niveau doctrinal que dans la pratique des Etats. Ces débats visent à montrer si un droit de défense préventive a pu s'instaurer dans la coutume internationale. Dans ce but, nous commencerons à examiner le cas d'Osirak (le bombardement d'Israël les installations nucléaires irakiens en 1981), pour arriver à la guerre des Etats-Unis contre l'Irak (2003) en passant par la guerre de l'Afghanistan. (2001). Les débats se divisent dans deux parties dont la première se refera à l'analyse de lex ferenda pour savoir si les comportements de certains Etats à cet égard ont pu montrer l'instauration de lex lata de la légitime défense préventive après la guerre froide. Dans cette ligne, la thèse présente une discussion assez complète autour des cas de l'attaque violente d'Israël contre l'Irak (1981) et celle des Etats-Unis à l'égard de l'Irak (2003). Puisqu'on a surtout pu constater l'hésitation de la communauté internationale et même de la participation de certains Etats à la Coalition qui a mené la deuxième guerre. Subséquemment, la seconde partie s'intéressera à examiner l'exercice de la légitime défense préventive à la lumière des conditions inévitables du droit de légitime défense pour conclure que la théorie de la défense préventive bouleverserait la structure de la règle de légitime défense.

Résumé / Abstract : This thesis contains the controversies on the mutation of the principle of prohibition of the use of force, both at the doctrinal echelon and in the practice of States. These discussions aim at knowing if a so-called right of preventive self defence could be established in customary international law. In this purpose, we shall begin to examine the case of Osirak (the bombardment of Israel Iraqi nuclear facilities in 1981), as a real reference to the question, to arrive at the war of the United States against Iraq (2003) while passing by the war of Afghanistan. (2001) Also, the thesis covers the legal debates on the legitimacy of resorting to self—defence in order to take away the threat of terrorism To study deeply the divergence between the law texts and the conducts of certain states, the discussions are divided in two parts whose first will refer to analyze the lex farenda to know if the behaviors of some states would show the establishment of lex lata of preventive self-defence after the cold war when there was some reluctance of the international community and even the participation of some States to the Coalition which carried out the above- mentioned second war against Iraq (2003). Subsequently the second part will be interested to examine the exercise of the preventive self defence in the light of the inevitable conditions of the right of self-defence to conclude that the theory of preventive defence would upset the structure of the rule of the self defence
