Résumé / Abstract : Cette thèse présente le parcours difficile du droit en matière d’investissements directs à l’étranger vers son internationalisation. La difficulté d’intégration dans le droit international des normes juridiques régissant l’investissement étranger a été due aux changements intervenus dans les relations internationales, à la suite de confrontations politiques, idéologiques et surtout économiques entre les pays. Les mécanismes conventionnels, les traités bilatéraux et la multiplication des arrangements régionaux ont contribué à une juridicisation nouvelle de la société mondiale. Cependant, ce n’est qu��un instrument multilatéral global, généralement accepté et qui échapperait de ce fait aux rapports de pouvoir au niveau mondial qui pourrait consacrer l’avènement d’un droit international en matière d’investissements directs étrangers. Assurant la stabilité du système multilatéral, il serait l’outil juridique qui permettrait de régir différemment la mondialisation économique.
Résumé / Abstract : This thesis presents the difficult path to dedicating at the international level the law dealing with foreign directs investments. The difficulty of integrating in the main body of the international law of the juridical standards concerning the foreign directs investments has been due to the changes interfered in international relationships. These changes were brought about by political, ideological and, most of all, economic confrontations among countries. The customary mechanisms, the bilateral treaties and the increase of regional arrangements have contributed to create a new jurisdiction of the world society. However, only a global multilateral instrument, generally accepted, could establish the enactment of an international law for foreign directs investments. This instrument should be able to transcend and go beyond the power relationships existing worldwide. Thus, assuring the stability of the multilateral system, it could be the juridical instrument allowing to manage the economic globalization in a different way.
