Résumé / Abstract : Deux lois de 1789 et 1790 ont instauré la commune en conférant au maire une mission de "bonne police" dans les lieux publics. Une loi de 1884 participera de la systématisation de la notion plus vaste sous-tendant l'action de la puissance publique sur ce plan : celle d'ordre public. La notion d'ordre public correspondra donc à l'intervention d'un droit objectif et autoritaire visant à prévenir ses éventuels troubles ou atteintes, ceci par une action coercitive de la puissance publique ou par une action de production normative. La notion d'ordre public a elle-même évolué et s'est ouverte à des composantes dématérialisées, permettant de s'interroger sur son lien avec un média de communications électroniques dématérialisées dans une dimension mondiale. L'Internet posera donc la question des nouveaux modes d'intervention de la puissance publique sur ce média ainsi que leurs limites face à la sphère privée de l'Internaute. Le caractère global de l'Internet confrontera aussi cette notion française d'ordre public à un cadre supranational ainsi que ses modes et fondements d'intervention de la puissance publique à d'autres systèmes ou cultures juridiques.
Résumé / Abstract : A couple of laws dated from 1789 and 1790 have established the local council conferring the mayor a duty of “good police” in public areas. A law dated from 1884 will be part of systematization of a large notion underlying the action of public power: public order. The notion of public order will correspond to the intervention of an objective and authoritarian in order to prevent any unrest or infringement by a coercive action or a normative action. The notion of public order has itself evolved and opened to unmaterial components, allowing to question on its link with a global electronic media. The Internet will then ask about the new ways of public intervention on such a media and their limits in view of the Internet's user privacy. The aspect of globalization of the Internet will also confront that French notion of public order to a supranational framework as well as the ways and foundations of public power intervention to others law systems or cultures.
