Résumé / Abstract : La participation directe des salariés au pouvoir dans l'entreprise est sans nul doute le parent pauvre du principe général de participation tel qu'il est décrit par les rédacteurs de l'alinéa 8 du Préambule de la Constitution de 1946 et par l'Organisation Internationale du Travail. Les interrogations sur cette association particulière du capital et du travail ne manquent pas. En effet, comment admettre qu'un ou plusieurs salariés se joignent personnellement à la direction et à la gestion de l'entreprise ? Comment comprendre cette brèche dans la toute puissance des propriétaires du capital ? Mais aussi, d'un autre côté, peut-on encore ignorer la force de l'actionnariat salarié et nier la nécessité de lui reconnaître une représentation stable au sein des conseils d'administration ou de surveillance ?
Résumé / Abstract : The direct participation of the workers in the firm is without doubt the poor relation of the principle of participation as it is presented at the eight line of the Preamble to the Constition of 1946. The questions about this particular associatiobn of the work and the capital are numerous. How can we accept that one worker is able to manage the firm ? How can we be unawe of the stength of the works owning shares in their company ? How can we refuse to the them a stable representation in the board ?
