Résumé / Abstract : Le but de ce travail est d'essayer de donner plus d'importance et de valeur à l'institution de la conciliation, en montrant son intérêt et son utilité. Pour arriver à cette fin, il nous a fallu étudier et essayer d'expliquer la législation existant en la matière, étant donné que depuis la mise en vigueur de la loi du 5 juillet 1975, elle n'a pas fait l'objet d'une étude approfondie. Nous avons également tenté de comprendre et, par conséquent, de commenter les quelques décisions judiciaires rendues par les différentes juridictions. A ce propos, notre souci majeur est de montrer que la conciliation, voire la tentative de conciliation n'a pas été réglementé dans le but de multiplier les textes, ou tout en la considérant comme une simple et vaine formalité, mais, au contraire, en vue d'une application soigneuse et sereine par les juges conciliateurs.

Résumé / Abstract : The aim of this work is to try to give more importante to the institution of conciliation, showing its interest and usefulness. To reach that aim, we had to study and try to explain the existing legislation, given that since the application of the law of july 5th, 1975 it has not been the subject of a serious study. We have also tried to understand, and therefore to comment the few judicial descisions stated by the different juridictions. Concerning that subject, our major problem is to show that the conciliation, even the attempt to reach conciliation was not ruled in the purpose of increasing the texts or as if it was considered as a simple and useless formality, but on the contrary in order to have a precise and serene application by the conciliatory judges.
